Understanding of SERFAESI Process and DRT Proceedings – 13(2), 13(3A)13(4), Section 14, Rule 8, Rule 9, CMM /DM application, Corporate Finance, CE Finance.

Profound knowledge of Types of Mortgage, Processes of Mortgage, Due Diligence of Mortgage, Lease, Creation of charge over an asset, title search, Registration Act, Transfer of Property Act, Contract Act, Specific Relief Act, Civil Procedure Code, Arbitration and Conciliation Act.

Good and effective Drafting skills

Proficiency in preparing drafts for legal cases, loan documents, and briefs, and giving opinions on various issues.

The capability of forming strategies & advising on Debt Recovery

Knowledge of 138 Negotiable Instrument Act.

Excellent oral and written communication, with proven skills in consulting with internal teams and external customers

Team player and ability to motivate team members to achieve their goals

Self-motivated, passionate about the domain, eager to learn current things, and takes the initiative & challenges

Team Leadership and Team Development: Building a high-performing motivated legal collection team by working closely with the team member for implementing the recovery agenda through appropriate training, coaching & mentoring, and leading them as an example.

Portfolio management:



Keeping NPAs at minimum trigger levels and lowering them through legal means and compliance within predetermined timeframes will help you manage portfolio movement and control loss.

Legal

Identifying and appointing reputable law firms and lawyers in the area to provide advice and guidance to the regional collections team

Maintaining and protecting the collaterals that are in the company's custody following surrender or repossession with proper adherence to SARFAESI Act guidelines.

Keeping up with all the most recent developments /trends in local law / best practices with regard to collections, security creation, and loans

Collection Management

Managing legal issues for collection matters in the designated region state by collaborating with regional collection teams to recover debts from persistent NPA cases through legal intervention

Collaborating with external vendors and agencies for the execution of the various stages of the SARFAESI Act, as well as managing all legal and SARFAESI compliance issues for the organization.

Arranging or looking out for buyers for the property against which auction notice has been published and/or private treaty towards closure of accounts under SARFAESI

Handling High Court, District Court, DRT & Securitization Cases, NCL & GCL Recovery, Consumer Forum, Criminal, Arbitration cases, and HNI customer cases

Relationship Management

Maintaining a solid relationship with internal departments namely with operations, credit, and sales functions

Taking actual control of the mortgaged property in coordination with local law enforcement and enforcement authorities, and making sure that appropriate action is taken to advance the cases and bring them to a legal resolution as indicated.

Data Management: Keeping track of the progress of all the cases filed by the company in the region to ensure timely circulation of legal MIS on all FOR and AGAINST cases
