Role Description
We are hiring a Legal Counsel to drive our recovery litigation portfolio — Section 138 NI Act prosecutions, MSME Samadhaan claims, arbitration, and enforcement against defaulting counterparties. This is a high-volume, deadline-driven role where speed and procedural precision translate directly into recovered money. You'll own cases end-to-end and work closely with Collections, Finance, and the Business teams.
Key Responsibilities
MSME Samadhaan / Delayed Payment Recovery
● File and prosecute delayed payment applications on the MSME Samadhaan portal under Sections 15–18 of the MSMED Act, 2006
● Assess claim eligibility — Udyam registration status, supplier classification, 45-day payment window, and the date the cause of action accrued
● Compute and claim compound interest at three times the RBI bank rate under Section 16
● Represent the company before the MSEFC (Micro & Small Enterprise Facilitation Council) through conciliation and arbitration stages
● Handle the full portal workflow: application filing, document upload, responses to buyer objections, hearing attendance, and follow-through to award
● Pursue enforcement of MSEFC awards; defend against Section 34 challenges and the Section 19 pre-deposit requirement
● Also defend Samadhaan claims filed against the company where we are the buyer — assess exposure and drive settlement
● Advise the business on structuring vendor/customer contracts and payment terms to preserve or limit MSMED exposure
Cheque Bounce (Section 138, Negotiable Instruments Act)
● Draft and issue statutory demand notices within the 30-day limitation window
● File Section 138 complaints before Magistrate courts within the 30-day cause-of-action period
● Manage the full lifecycle: complaint, sworn statement, summons, bailable/non-bailable warrants, evidence, cross-examination, final arguments
● Track limitation dates rigorously across a large docket — no missed deadlines
● Pursue Section 143A interim compensation and Section 148 deposit applications at appellate stage
● Handle compounding, settlements, and withdrawal on payment
Recovery, Arbitration & Enforcement
● File and pursue summary suits under Order XXXVII CPC and regular recovery suits
● Initiate arbitration under contractual clauses; manage arbitrators, hearings, and awards
● Execute decrees and awards — attachment, garnishee, execution petitions
● Evaluate and file Section 9 IBC petitions against corporate defaulters where recovery is viable
● Handle SARFAESI / DRT matters where applicable
● Respond to counter-claims, Section 482 quashing petitions, and defence applications
Portfolio & Stakeholder Management
● Maintain a live case tracker: forum, stage, next date, exposure, recovery probability
● Choose the right forum per file — Samadhaan vs. Section 138 vs. summary suit vs. arbitration — based on speed, cost, and recoverability
● Brief, instruct, and manage panel advocates across jurisdictions; review drafts and control legal spend
● Report recovery numbers, aging, and outcomes to management through clear MIS
● Vet contracts, security documents, and guarantees to close enforceability gaps upstream
Requirements
● LL.B. from a recognised university; enrolment with a State Bar Council (mandatory — appearances required)
● 3–4 years of post-qualification experience in recovery and commercial litigation
● Hands-on experience filing and prosecuting matters on the MSME Samadhaan portal and appearing before MSEFC
● Demonstrable experience with Section 138 NI Act matters at volume
● Working knowledge of the MSMED Act, 2006, CPC, CrPC/BNSS, and the Arbitration & Conciliation Act, 1996
● Strong drafting, limitation-tracking discipline, and the ability to run 100+ active matters without dropping dates
● Comfortable working with online filing portals and case management systems
Nice to Have
● Experience on both sides of MSME delayed payment claims (claimant and respondent)
● Prior experience with an NBFC, bank, fintech lender, manufacturing company, or recovery-focused law firm
● Multi-state litigation exposure and an existing panel advocate network
● Exposure to SARFAESI, DRT, and IBC proceedings
