A retired Illinois firefighter and Marine Corps veteran has filed a lawsuit alleging that contaminated raw oysters served at a suburban Chicago steakhouse caused a catastrophic medical emergency that left him with permanent brain injuries and in need of lifelong care, CBS News said.
The lawsuit was filed on behalf of Joe Belgio, 44, who claims he became gravely ill after eating raw oysters at Gibsons Bar & Steakhouse in Oak Brook on June 30, 2025. Attorneys representing Belgio announced the legal action this week, alleging the meal triggered a chain of medical complications that dramatically altered his life, abc7chicago.com reported.
According to the complaint, Belgio and his family had gathered at the restaurant for a celebration when he consumed the oysters. His fiancée, Melanie Stayer, said the outing was intended to be a joyful family occasion shortly after the couple welcomed a daughter.
Several days later, Belgio allegedly suffered a severe medical episode that included cardiac arrest.
Attorneys said the loss of oxygen during the event resulted in significant and lasting neurological damage. He has remained hospitalized for more than a year and now requires constant medical supervision, according to court filings and statements from his legal team.
The lawsuit alleges medical testing identified multiple pathogens commonly associated with contaminated shellfish. Attorneys claim those organisms caused the illness that ultimately led to Belgio’s collapse and subsequent brain injury.
Belgio’s attorneys contend that physicians determined his illness and subsequent injuries were linked to the oysters he consumed at the restaurant. The lawsuit also names seafood supplier Supreme Lobster and Seafood Company as a defendant.
