Job Description - Direct Taxation
Position: Manager
Experience Required: 5-10 Years of Experience
Direct Taxation Corporate Tax / Tax Compliance & Litigation
Role Overview
Responsible for managing and overseeing the organizations end-to-end Direct Tax function, including corporate tax compliance, TDS, income-tax assessments, tax audit, international tax matters, litigation and regulatory reporting. The role involves close coordination with internal stakeholders, tax consultants, statutory auditors and tax authorities to ensure timely compliance, effective tax risk management and appropriate resolution of tax matters.
Key Roles & Responsibilities
1. Corporate Taxation & Tax Compliance
- Manage the organization’s end-to-end corporate income-tax compliance and ensure adherence to applicable provisions of the Income-tax Act, Rules, notifications and circulars.
- Review and oversee preparation and filing of the Income Tax Return (ITR) within prescribed timelines.
- Undertake advance tax computation and quarterly liability assessment, considering current-year profitability, tax positions and applicable adjustments.
- Monitor tax positions and identify potential areas of tax exposure, compliance risk and opportunities for tax optimization.
- Coordinate with internal Finance/Accounts teams for tax data, reconciliations and supporting documentation.
2. TDS Compliance & Withholding Tax
- Manage the monthly computation of TDS liabilities across applicable categories of payments.
- Review applicability of withholding tax provisions under the Income-tax Act and ensure appropriate deduction of tax at source.
- Oversee timely filing of quarterly TDS returns, including validation and reconciliation of TDS data.
- Monitor TDS-related notices, defaults, interest and other compliance matters and coordinate their resolution.
- Ensure appropriate tax withholding on domestic as well as applicable cross-border transactions.
3. Tax Audit & Regulatory Reporting
- Coordinate and oversee the Tax Audit process, including preparation, review and submission of the Tax Audit Report.
- Coordinate with Tax Auditors and internal stakeholders for identification and evaluation of tax audit disclosures.
- Manage reporting requirements relating to Specified Financial Transactions (SFT) and ensure completeness and accuracy of relevant information.
- Ensure appropriate reconciliation of tax-related disclosures with books of accounts, financial statements and statutory filings.
4. International Taxation & DTAA
- Evaluate tax implications of cross-border transactions with reference to the Income-tax Act and applicable Double Taxation Avoidance Agreements (DTAAs).
- Review applicability of withholding tax on international remittances and payments to non-residents.
- Oversee Form 15CA and Form 15CB compliance, including coordination with authorized professionals wherever required.
- Coordinate with consultants and internal stakeholders on international tax matters and documentation requirements.
5. Assessments, Scrutiny & Tax Proceedings
- Manage and coordinate Income Tax scrutiny/assessment proceedings, including collation and submission of information and supporting documents.
- Review notices issued by the Income Tax Department and coordinate appropriate responses within prescribed timelines.
- Handle Section 154 rectification proceedings, including identification of apparent errors, preparation of submissions and follow-up with the tax authorities.
- Maintain a comprehensive tracker of assessments, notices, demands, rectification matters and other tax proceedings.
- Coordinate with external tax consultants and legal professionals for complex assessment and departmental matters.
6. Tax Litigation & Appeals
- Manage the organization’s Direct Tax litigation portfolio and coordinate resolution of ongoing tax disputes.
- Oversee preparation and filing of appeals before the Commissioner of Income Tax (Appeals).
- Coordinate with tax consultants, advocates and authorized representatives in relation to litigation matters.
- Review grounds of appeal, submissions, factual documentation and supporting legal positions.
- Track hearing dates, submissions, orders and subsequent actions to ensure effective litigation management.
- Evaluate tax demands and potential exposures arising from assessment and appellate proceedings and communicate material matters to management.
7. Stakeholder & Consultant Management
- Act as the key point of coordination with Tax Consultants, Statutory Auditors and Tax Auditors on Direct Tax matters.
- Coordinate with Finance, Accounts, Treasury, Legal, Business and other relevant internal teams for tax-related requirements.
- Review deliverables received from external consultants and ensure alignment with the organization’s tax positions and business requirements.
- Provide tax inputs for business transactions, contracts and financial decisions wherever required.
- Ensure timely escalation and reporting of significant tax risks, disputes and potential exposures to senior management.
