Education qualification - LL.B. from a recognized university (Mandatory)/

LL.M. will be preferred

Job Description / Responsibilities-

Role Overview

Legal Consultant with a minimum of 10 years of experience in the Mumbai real estate sector, specializing in non-litigation matters. The candidate should have extensive exposure to Redevelopment Projects, MHADA, SRA, BMC approvals, title due diligence, regulatory compliance, and real estate documentation.

The role will be responsible for providing legal support across all project stages, ensuring compliance with applicable laws and minimizing legal risks while enabling smooth project execution.

Key Responsibilities

Redevelopment & Real Estate Projects

- Handle legal aspects of housing society redevelopment projects.
- Review and advise on Development Agreements, Permanent Alternate Accommodation Agreements (PAAA), and related documentation.
- Coordinate with societies, landowners, developers, consultants, and government authorities.
- Provide legal support for project acquisitions, redevelopment and joint development arrangements.

MHADA, SRA & BMC Matters

- Manage legal matters related to:
- MHADA projects
- SRA (Slum Rehabilitation Authority) projects
- BMC permissions and approvals
- MMRDA and other statutory authority approvals




- Collector and Revenue Authorities matters

- Interpret and advise on regulations, circulars, and policy changes impacting projects.

Title Investigation & Due Diligence

- Conduct title searches and property due diligence.
- Examine Property Cards, 7/12 extracts, CTS records, mutation entries, and land records.
- Identify legal risks associated with properties and provide mitigation measures.
- Prepare Title Verification Reports and Legal Opinion Reports.

Drafting & Documentation

- Draft, vet, review and negotiate:
- Development Agreements
- Joint Venture Agreements
- Joint Development Agreements
- Conveyance Deeds
- Sale Agreements
- Leave & License Agreements
- Memorandums of Understanding (MOUs)
- Powers of Attorney
- Indemnities and Declarations
- Vendor and Consultant Agreements
- Redevelopment Documentation
- Society-related Agreements and Resolutions

Legal Compliance

- Ensure compliance with:
- RERA
- MOFA
- Maharashtra Cooperative Societies Act
- Maharashtra Regional and Town Planning Act (MRTP)
- Maharashtra Land Revenue Code
- Registration Act
- Stamp Duty Act
- Transfer of Property Act

- Monitor legal risks and ensure statutory compliance for ongoing projects.

Liaison & Advisory

- Liaise with advocates, architects, liaison consultants, surveyors and statutory authorities.
- Attend meetings with societies, stakeholders and management.
- Provide practical legal solutions aligned with business objectives.
