Position: Manager – Trade Mark
Position Summary:
The Manager – Trademarks will take complete end-to-end ownership of the organization’s trademark and brand protection portfolio across two distinct business verticals: FMCG (fast-paced, high-volume product launches and aggressive marketing timelines) and Pharmaceuticals (highly regulated, therapeutic-class restricted, and high-risk).
This role requires a blend of fast-track clearable strategies and strict regulatory risk mitigation. You will oversee brand, product name, and logo clearances, manage full-lifecycle prosecution, handle contentious proceedings, and drive external counsel to align trademark strategies with commercial goals.
Key Responsibilities
1. End-to-End Search & Brand Clearance
- Conduct comprehensive trademark, preliminary, and availability searches for proposed brand names, product names, logos, taglines, and trade dress across global and regional databases.
- Evaluate risks for rapid-moving FMCG launches (ensuring speed-to-market without infringing third-party rights) and Pharma products (evaluating phonetic/visual similarities, look-alike sound-alike [LASA] risks, and safety/regulatory overlaps).
- Deliver clear, actionable legal risk assessments and clearance opinions to marketing, R&D;, and executive leadership.
2. Registration, Prosecution & Portfolio Management
- Manage the entire lifecycle of trademark applications from filing to registration, renewals, and maintenance across international jurisdictions (via Madrid System or direct filings).
- Draft, file, and track trademark applications across relevant classes
- Prepare robust,
strategic responses to Examination Reports and official objections issued by Trademark Registries.
3. Contentious Matters (Objections, Oppositions & Enforcement)
- Identify, draft, and file Oppositions, Rectifications, Revocations, and Invalidations against infringing third-party marks.
- Draft legal notices, cease-and-desist letters, counter-statements, and evidence in support of oppositions.
- Manage opposition matters end-to-end, including framing arguments, negotiating co-existence/settlement agreements, and preparing for hearings.
4. External Attorney & Vendor Management
- Direct, coordinate, and manage relationships with law firms and external trademark attorneys across domestic and international jurisdictions.
- Review work products, track SLA compliance, control external litigation costs, and optimize fee schedules.
5. Cross-Functional Support & Brand Protection
- Work closely with Marketing, Brand Management, R&D;, Packaging, Regulatory Affairs, and Commercial teams during early-stage product development.
- Review packaging art, promotional materials, digital campaigns, and product labels to ensure trademark compliance and prevent accidental infringement.
- Monitor market trends and e-commerce platforms to identify counterfeiting, unauthorized usage,
or trademark squatting.
Education & Experience Requirements
- Educational Qualification:
- Bachelor of Laws (LL.B.) or Master of Laws (LL.M.) from a recognized university.
- Preferred: Registered Patent/Trademark Agent qualification or certifications in IP Law.
- Experience:
- Minimum of 8 to 12 years of focused experience in Trademark and Brand Protection management.
- Must have a proven track record managing IP in both FMCG (fast-paced marketing demands) and Pharma/Healthcare (regulatory risk and therapeutic classification compliance).
- Substantial experience handling domestic and international trademark portfolios (Madrid Protocol, direct filings).
Key Competencies & Technical Skills
- Search & Clearance Mastery: Advanced proficiency with IP search tools (TESS/USPTO, WIPO Brand Database, TMView, and local IP office databases).
- High-Risk Regulatory Acumen: In-depth understanding of Pharma-specific brand risks, including INN (International Nonproprietary Names) restrictions, medical confusion, and regulatory guidelines.
- Strategic Speed: Ability to handle high volumes, tight deadlines, and shifting priorities driven by commercial launch dates.
- Negotiation & Drafting: Superior legal drafting skills for oppositions, counter-statements, non-disclosure agreements, co-existence agreements, and licensing contracts.
- Stakeholder Communication: Outstanding ability to translate complex IP concepts into clear risk decisions for non-legal business leaders.
