Position Summary

MAHOFIN is seeking an experienced and proactive Legal Counsel to provide end-to-end legal support for its lending and financial services operations. The role will be responsible for managing legal risk, litigation, regulatory compliance, loan documentation, recovery proceedings, and legal advisory functions while ensuring adherence to applicable laws and regulatory requirements.

The ideal candidate should possess strong expertise in financial services, contract management, recovery laws, property-related legal matters, and litigation management.

Key Responsibilities

Legal Advisory & Business Support

- Provide legal advice to business, credit, collections, operations, and management teams on various legal and regulatory matters.

- Identify legal risks associated with lending, recovery, and operational activities and recommend mitigation measures.

- Support strategic business initiatives with sound legal guidance.

Loan Documentation & Contract Management
- Draft, review, and vet loan agreements, security documents, guarantees, mortgages, hypothecation agreements, and other financial contracts.

- Ensure legal enforceability and compliance of all customer and business documentation.

- Manage standard templates and contractual documentation processes.

Litigation & Recovery Management
- Handle civil, criminal, consumer, arbitration, and recovery-related cases.

- Coordinate with external advocates, recovery agencies, and legal consultants.

- Oversee legal recovery proceedings under applicable laws and regulatory frameworks.

- Monitor court cases and ensure timely filing of pleadings, responses, and appeals.

Property & Security Documentation




- Conduct legal scrutiny of property documents and title verification.

- Review mortgage-related documents and create legal opinions regarding collateral security.

- Support due diligence activities for secured lending transactions.

Regulatory Compliance
- Ensure compliance with applicable RBI regulations, financial services regulations, and statutory requirements.

- Monitor changes in laws and regulations affecting lending and recovery operations.

- Develop and implement legal compliance practices across business functions.

Legal Risk Management
- Evaluate legal, contractual, and operational risks.

- Maintain litigation trackers, legal MIS, and compliance reports.

- Recommend preventive legal strategies to minimise disputes and financial exposure.

Stakeholder Coordination
- Liaise with internal departments, regulators, advocates, law enforcement agencies, and government authorities.

- Support audits, inspections, and regulatory reviews from a legal perspective.

Qualifications & Experience

Education

- Bachelor's Degree in Law (LLB) from a recognised university.

- Enrolment with the Bar Council of India is mandatory.

- LLM or relevant professional certifications will be an added advantage.

Experience
- 7-12 years of post-qualification experience in legal functions within NBFCs, financial institutions, banks, housing finance companies, or corporate legal departments.

- Proven experience in lending documentation, legal recovery,



litigation management, compliance, and property due diligence.
