Position: Cross-Border Tax Advisor / Semi-Qualified CA — International Taxation & NRI Advisory
Location: Current Delhi (Hybrid) / Remote considered for the right candidate

We operate across India–US, India–UK, and India–Dubai corridors, handling everything from tax return filings and FEMA/RBI compliance to complex multi-jurisdiction structuring — through our Indian entity, Incross Fintech LLP, and our US CPA arm
About the Role
We're looking for someone who can independently own client engagements involving Indian tax law, FEMA, and cross-border/international tax matters for our NRI client base — people either returning to India, moving abroad for the first time, or already settled overseas and needing ongoing tax planning. This is a client-facing advisory role, not a back-office compliance seat — you'll be on calls with clients, structuring their tax position, and making judgment calls on real cross-border scenarios.
Key Responsibilities
Evaluate and advise on client taxation positions across jurisdictions — determining residential status, applicable tax treatment, and the most favorable, defensible structuring for each client's specific facts
Structure and advise on DTAA (Double Taxation Avoidance Agreement) positions — treaty residency tie-breaker rules, foreign tax credit claims, avoiding double taxation across jurisdictions
Advise on POEM (Place of Effective Management) rules for clients with business interests, directorships, or control functions spanning India and abroad — assessing POEM exposure and structuring to manage residency/PE risk for individuals and their entities
Handle cross-border tax positions specifically for OCI holders, PIO cardholders, Green Card holders,
and other overseas persons of Indian origin — each of these carries distinct residency, reporting, and treaty implications that require separate treatment from standard NRI cases
Advise NRI/OCI/Green Card-holding clients on Indian income tax implications of moving to India (residency status determination, RNOR planning, asset repatriation) and moving abroad (exit tax planning, FEMA compliance on remittances, closing/converting resident accounts to NRO/NRE)
Provide ongoing tax planning and advisory — not just compliance filing — covering income structuring, investment timing, and remittance sequencing to optimize a client's overall cross-border position
Handle mobility tax matters for clients relocating for employment or business — split-year residency, social security totalization considerations, employer withholding issues
Prepare and file Form 15CA/15CB for outward remittances, ensuring correct classification and treaty applicability
Advise on and file for Lower/Nil TDS deduction certificates (Form 13 applications) for NRI clients on rental income, property sale proceeds, and other India-sourced income
Handle FEMA compliance — NRO/NRE account matters, repatriation limits, property transaction rules, FC-GPR and related RBI filings where applicable
Advise on PFIC (Form 8621), FBAR, and Form 8938 matters for US-linked clients in coordination with our US CPA team, and equivalent disclosure requirements for other jurisdictions
Compute and structure capital gains across property sales, mutual funds, and securities for clients with cross-border tax exposure
Independently manage client relationships end-to-end: discovery calls, scoping,
technical execution, and ongoing advisory — not just return preparation
Stay current on Indian direct tax law, FEMA amendments, POEM guidelines, and relevant international tax treaty updates
What We're Looking For
Qualification
Semi-qualified CA (CA-Inter cleared, articleship completed) or qualified CA
Additional international tax certifications (ADIT, US-focused CPA coursework, or equivalent) are a strong plus but not mandatory if practical experience is strong
Experience
Hands-on, practical experience in cross-border/international taxation — this is not an entry-level compliance role
Prior exposure to NRI/OCI/PIO/Green Card taxation, DTAA application, POEM analysis, FEMA, and Form 15CA/15CB filings is essential
Working knowledge of US tax law (individual filing, PFIC, FBAR/FATCA basics) is highly preferred given our client mix, though deep India-focused candidates without US exposure will still be considered if the rest of the profile is strong
Experience at a Big 4 firm, a boutique cross-border tax practice, or as an independent NRI tax consultant strongly preferred
Demonstrated experience directly advising individual NRI/OCI/overseas-Indian-origin clients (not just corporate/institutional tax work) — this role is relationship-heavy
Skills
Strong grasp of Indian direct tax law as it applies to residents, non-residents, RNOR individuals, and persons of Indian origin holding foreign citizenship/status (OCI, Green Card, etc.)
Working understanding of POEM principles and how they interact with individual and closely-held entity structures
Practical fluency with lower TDS certificate applications and processing
Comfortable owning client conversations independently — explaining technical positions in plain language to non-technical clients
Detail-oriented; cross-border filings leave little room for error given treaty and multi-jurisdiction stakes involved
