1. Role Overview

CAPITALEX is seeking an Associate / Senior Associate with 3 8 years of relevant experience in Insolvency and Banking Litigation.

The role involves independently managing litigation matters before DRT, DRAT, NCLT and NCLAT, including drafting, filing, hearings and case management.

Candidates should possess practical knowledge of the Insolvency and Bankruptcy Code (IBC), 2016, and the SARFAESI Act, 2002.

Preference will be given to advocates capable of independently handling matters from the date of joining.

2. Key Responsibilities

1. Independently manage litigation proceedings before DRT, DRAT, NCLT and NCLAT.

2. Draft and file petitions, applications, replies, written submissions and appeals.

3. Handle matters under the Insolvency and Bankruptcy Code (IBC), 2016.

4. Manage SARFAESI Act proceedings, including Section 13(2) and Section 13(4) actions.

5. Handle IBC Section 7, Section 9 and Section 10 petitions.

6. Work on corporate insolvency resolution proceedings, resolution plans and avoidance applications.

7. Represent clients in tribunal hearings and appellate proceedings.

8. Prepare legal arguments, case briefs and supporting documentation.

9. Coordinate with banks, financial institutions, resolution professionals and corporate clients.

10.



Develop case strategies and ensure compliance with procedural requirements and filing deadlines.

11. Maintain case records, hearing schedules and litigation documentation.

12. Monitor relevant judgments of the Supreme Court, High Courts, NCLT, NCLAT, DRT and DRAT.

3. Required Qualifications
- LL.B. or LL.M. degree from a recognized university.

- Enrollment with a Bar Council in India and an active practice certificate.

- 3 8 years of relevant litigation experience.

- Practical knowledge of IBC, 2016 and the SARFAESI Act, 2002.

- Demonstrated experience in independent drafting, filing and appearances before DRT, DRAT, NCLT and/or NCLAT.

- Robust legal drafting, litigation management and advocacy skills.

- Ability to manage multiple matters independently.

- Proficiency in written and spoken English.
