- Responsible for overseeing end-to-end legal recovery proceedings, formulating legal strategies for non-performing assets (NPAs) and stressed accounts, and managing legal actions under the SARFAESI Act, Arbitration, Section 138/141 (NI Act), Section 25 (PAYPA), and Insolvency & Bankruptcy Code (IBC). You will partner closely with the Collections, Credit, and Risk management teams to maximize recoveries while upholding compliance and statutory frameworks.
- Manage high-value and critical delinquent LAP accounts requiring tailored legal solutions, settlements, or enforcement actions.
- SARFAESI Act:Oversee end-to-end execution of SARFAESI proceedings, including issuance of 13(2) and 13(4) notices, physical possession orders via District Magistrate/CMM (Section 14),
and organizing public auctions under Rule 8/9.
- - **Arbitration:Lead arbitral proceedings from invocation, appointment of arbitrators, securing interim relief under Section 9, to filing enforcement/execution petitions under Section 36.
- - **Cheque & Mandate Dishonor:** Manage litigation strategy and execution for cases under Section 138/141 of the Negotiable Instruments Act and Section 25 of the Payment and Settlement Systems Act (PAYPA).
- - & Criminal Litigation:** Supervise summary suits, civil suits, writ petitions, injunctions, criminal complaints, and insolvency proceedings (NCLT/IBC) where applicable.
