Associate – Litigation | Section 138 NI Act & Section 25 PSS Act

About the Role

CreditUp Technology Pvt. Ltd. is looking for a hands-on litigation professional with strong expertise in Section 138 of the Negotiable Instruments Act, 1881 and Section 25 of the Payment and Settlement Systems Act, 2007. The ideal candidate should have substantial practical exposure to Magistrate Courts and criminal proceedings, possess valuable courtroom skills, and be comfortable independently handling matters from filing through evidence and trial.

Key Responsibilities

· Independently handle Section 138 NI Act and Section 25 PSS Act matters before various Magistrate Courts.

· Draft and vet complaints, legal notices, applications, replies, affidavits, evidence affidavits, written submissions and other pleadings.

· Handle matters at various stages including filing, scrutiny, cognizance, issuance of summons, appearance, plea, evidence, cross-examination, arguments and final disposal.

· Conduct and assist in cross-examination of complainants/witnesses and effectively handle trial proceedings.

· Handle bail applications, exemption applications, warrant-related proceedings and other criminal procedural applications.

· Possess sound understanding of courtroom procedure, criminal procedure and day-to-day Magistrate Court practice.

· Independently appear before Courts and effectively argue procedural and substantive issues.

· Maintain and monitor case files, hearing dates, orders, compliance and case progression.

· Coordinate with clients, court clerks, advocates and internal legal teams.

· Undertake regular court visits and filing-related work as required.





· Be willing to travel to other cities and appear before Courts outside the home jurisdiction whenever required.

· Take ownership of assigned matters and ensure timely completion of court-related tasks.

Required Skills & Qualifications

· LL.B. degree from a recognised institution.

· 2–3 years of PQE in litigation, preferably with substantial experience in cheque-bounce and financial recovery matters.

· Strong practical knowledge of Section 138, Negotiable Instruments Act and Section 25, Payment and Settlement Systems Act.

· Working knowledge of relevant provisions of the BNSS/CrPC and Evidence Law.

· Practical experience in criminal trial and Magistrate Court procedures.

· Demonstrated experience in cross-examination and evidence proceedings.

· Practical experience in bail matters and criminal procedural applications.

· Good drafting, legal research and oral advocacy skills.

· Ability to independently appear and conduct matters before Courts.

· Strong understanding of courtroom etiquette and procedure.

· Excellent communication and interpersonal skills.

· Willingness to travel and actively work across Courts as required.
