Your responsibilities You take over the lead of Contract and Claim Management support during sales period and covers operative contract management, monitors the project from contractual point of view, executes claim prevention measures, triggers and leads the claim management process during in our EPF- and EPC-business with project volumes of € 50 Mio up to billions of EUR including consortium model. You shall act as interface between LEX and the Integrated Project Management Team.
Your responsibilities extend to the following: Supports the team during sales period with review of review terms and conditions (client, partners, subcontractor, critical suppliers), recommend strategy and setup to manage contractual risks & opportunities, check consistencies of contract annexes
Ensure set up of contract management processes during the whole project lifecycle of large EPF and EPC projects according to thyssenkrupp Nucera standards and governance – from ITB to end of warranty period.
Ensure leading the claim management process and functionally responsible for the project contract and claim including analysis of contractual risks and opportunities with Identifying potential claims and contractual deviations and execute defined measures
Fosters a common understanding and awareness of contractual contents and requirements within the project team including trainings
Monitoring project (correspondence, performance, deviations, milestones etc.), participating in and organize relevant meetings and workshops and for claim prevention, aligning claim strategies with PM/ Procurement/ CPM
Follow up claims (incoming & outgoing), preparing claims, drafting claim correspondence,
collecting & preparing documents for evaluation of claims, involve respective disciplines, drafting wording for contractual amendments, participate in claim negotiations, collecting/preparing & checking documents against claims, ensure close out of claims
Ensure transparent and timely reporting of claims and contract changes with maintaining the data quality of reporting tools
Review and comment subcontractor and critical supplier terms and conditions under consideration of risk mitigation and claim potential
Preparing and delivering Contract and claim management Lessons Learned feedback and conducting workshop
Ensure integration of and cooperation with Commercial project manager and legal team in each project Your profile Professional Experience At least 10 years of professional experience in negotiating and executing international EPF and EPC contracts of mechanical and plant engineering projects in the process or chemical industry with volumes up to hundreds-of-million Euro as Contract Manager including consortium nature of contracts
University degree/postgraduate in Law
Proven records of working with an international team – respective intercultural awareness and ability to leverage cultural differences
Experience in establishing complex contract scenarios and its resolution with expert knowledge in contract law and related laws for executing such contracts.
Drive and able to work under high pressure while still meeting highest level of results
Excellent English language skills (additional language is an advantage) Personal Qualities Excellent communication skills and being a team-player
