Key Responsibilities of a Mediator
- Maintain Impartiality: Act as an unbiased, neutral third party without favoring any participant or imposing personal opinions.
- Facilitate Communication: Encourage constructive dialogue, manage emotions, and help parties articulate their needs and interests clearly.
- Guide the Process: Establish ground rules, manage the mediation timeline, and structure sessions (joint sessions and private caucuses).
- Identify Core Issues: Assist parties in uncovering underlying concerns, clarifying misunderstandings, and isolating key points of disagreement.
- Support Option Generation: Guide parties to brainstorm, evaluate, and negotiate realistic and mutually acceptable solutions.
- Draft Settlement Agreements: Record agreed-upon terms clearly and neutrally to ensure mutual understanding and consensus.
- Ensure Confidentiality: Protect party privacy and uphold strictly confidential standards throughout and after the proceedings.
